TERMS OF USE
This Agreement (hereinafter - the «Agreement») sets forth the terms and conditions of use of the site https://yuvalstudios.com/ (hereinafter referred to as the «Portal»).
General provisions and rules for using the PORTAL
1. A legitimate user of the Trademark and Portal is an individual entrepreneur - Rymar Oleksandr Volodymyrovych (location - Ukraine, 21036, Vinnytsia region, Vinnytsia district, city Vinnytsia, str. Mayborody Dmitry, house 42, apartment 52), hereinafter referred to as the “legitimate user”.
2. Visitors to the Portal (hereinafter referred to as «Visitors») should familiarize themselves with this Agreement. In case of their disagreement with the terms and conditions set forth in this Agreement, Visitors must stop using the Portal. The use by the visitors of the portal and / or the information presented on it is a confirmation of acceptance by the Visitor of all the terms of the Agreement.
3. The user has the right to make changes to this Agreement, which enter into force upon publication on the Portal and are binding on all Visitors.
4. This Portal contains objects of copyright and intellectual property, signs for goods and services: graphic images, photo and video materials, music, texts, etc., the exclusive rights to use of which (output data, choice of location of intellectual objects property, additions or deletions, etc.) belong to the legitimacy of the user of the Portal.
5. The visitor has the right to download materials, objects of copyright, and intellectual property from the Portal for personal use only. In case of publication, distribution and/or other use of materials copied from the Portal, the Visitor agrees to indicate the source of materials (link to this Portal).
6. In case of violation of Clause 5 of this Agreement and/or other conditions stipulated by the Agreement, the Visitor is liable under the current legislation of Ukraine.
7. The visitor undertakes to use the Portal and its materials only within the framework of the current legislation of Ukraine. The Visitor is obliged not to post materials and information on the Portal containing threats and statements that violate public order, containing calls for inciting ethnic, religious, or racial hatred, calls for violence, to one degree or another affect honor and dignity, reputation, rights and legitimate interests other visitors to the Portal, as well as other materials that violate the current legislation of Ukraine.
8. The visitor may leave feedback and comments on the Portal, observing the restrictions/requirements stipulated by clause 7 of this Agreement. A legitimate user is not responsible for the personal opinion of Visitors who are the last left on the Portal.
9. The visitor is not entitled to use the Portal to place advertising materials; post information copied from the Portal on other information portals, in print media, as advertising materials, etc. without the written permission of the rightful user of the Portal; post intellectual property and copyright objects on the Site without the permission of their respective owners and the Rightful Portal user.
10. A legitimate user has the right to delete information and/or materials posted by the Visitor in violation of this Agreement and the current legislation of Ukraine, and also block (temporarily or permanently) without any explanation for his part, the actions of the Visitor in case of violation by the Visitor of the terms of this agreement and the requirements of applicable law.
11. The visitor is responsible for his actions and the losses caused by such actions within the framework of the legislation of Ukraine.
12. The visitor has the right to register on the Portal, providing accurate and reliable information during registration. After registration, the Visitor is assigned a username and password selected by the visitor, for the safety of which he alone is responsible. In case of violation by the Visitor of the conditions and requirements established by this Agreement and the current legislation of Ukraine, the Rightful User has the right to block the access of such Visitor to the Portal.
13. The rules for making purchases of the Goods on the Site.
13.1. When making a purchase of the Goods using the Portal, the Visitor entirely agrees with the conditions set forth in the Agreement and the terms of the Public Contract (Offer), which is posted on the Portal at: https://yuvalstudio.com/.
13.2. The date of placing the order to purchase the Goods shall be considered the date of completion by the Visitor of the electronic order to purchase goods.
13.3. To place an order for the purchase of goods, you must:
13.3.1. open the Portal link https://yuvalstudios.com/;
13.3.2. From the list of goods offered on the Portal, choose independently in the catalog of goods by clicking on the link to the goods;
13.3.3. having chosen «No», move it to the basket by clicking on the “Buy” button on the Portal.
13.3.4. An order for the purchase of goods must contain the name of the goods, information about the metal alloy and its sample, the mass and size of the goods, the name, characteristics, and weight of stones in the goods, the price of the goods, form of payment and delivery method, information about the visitor (surname, name, patronymic, mobile phone number, email address). To place a Purchase Order, you must fill out all the requested information. After entering the necessary (requested) information, confirm the execution of the Order for the purchase of goods by clicking the «Confirm Order» button.
13.3.5. The fact of registration and confirmation by the Visitor The order for the purchase of the Goods confirms that the Visitor has fully read and agrees with the terms of this Agreement, the terms of the Public Agreement (terms of payment, terms, and conditions of delivery, warranty, conditions for returning goods, etc.), with the Goods The purchase order of which was executed, including with its description, quality characteristics, price, an indication of the country of origin and other information about the product.
13.3.6. Confirmation of receipt of an order for the purchase of goods is an SMS message sent to the visitor by phone specified when placing the order for the purchase of goods.
13.3.7. Accepting order for the purchase of goods, a lawful user undertakes, within 24 hours from the moment of placing the order for the purchase of goods, to transfer the placed order to the seller of the goods indicated on the Portal.
13.3.8. A visitor to the Portal at the age of 14 (fourteen) to 18 (eighteen) years is required to obtain prior consent for such an action from parents or legal guardians to place an Order for the purchase of the Goods. In cases of disagreement of parents and/or legal guardians with the terms of this Agreement, the Public Agreement, the Visitor is obliged to refuse to use the Portal.
13.3.9. In cases of violation by the Visitor of the terms of this Agreement or the Public Agreement, blocking registration by the User or the Rightful User, all orders for the purchase of goods by this User are canceled and are not subject to execution.
13.3.10. After receiving the Order for the purchase of the Goods, the representative of the seller within 24 hours contacts the Visitor to clarify the terms and conditions of delivery of the goods.
13.3.11. An order for the purchase of goods is considered canceled if there is no connection with the visitor within three days from the moment the visitor places an order to buy the goods.
14. When placing an Order on the Site, the visitor gives permission to the Portal user to process his personal data in accordance with the Law of Ukraine «On the Protection of Personal Data». The visitor confirms that he is familiar with the rights enshrined in the Law of Ukraine «On the Protection of Personal Data». The Visitor allows the transfer of his personal data provided by the Rightful User solely for the purposes specified in this Agreement.
15. The purpose of collecting personal data of Portal Visitors is to increase the convenience of using the Portal and further communication with portal visitors.
16. The visitor, indicating his personal data, allows the legitimate user and his partners to send information, including advertising, by e-mail or SMS. In this case, additional consent from the Visitor is not required.
17. A legitimate user does not guarantee the absence of errors and failures, including in the operation of the software. A legitimate user will make every effort to eliminate any failures and errors if they occur as soon as possible.
18. A legitimate user is not responsible for failures and losses that occurred due to faults in the operation of equipment, communications of third parties, as well as in case of blocking access to the Portal as a result of unlawful actions of third parties.
